I have an impression that Musk became influenced and inspired by Russian “legal system” and this is what he really means here. Russia until 2022 had in principle quite modern laws - the problem was that they were applied selectively, so if you was a member of a specific caste they were never applied to you and if you were a member of another group, they were applied at double harshness. What Musk really means here is that the laws for mere mortals should be never applied to “people of power”, such as Trump. Of course, this goes against anything that the Western legal system was founded on, but clearly, this system of privilege can be tempting for people in power.

Unfortunately, good legal groundwork is nothing in the absence of legal culture/tradition that simply never existed here, this gave rise to badly written laws with vague wording, for example the ill-famous article 282 "Incitement to ethnic or racial hatred", which became the main device for the state to use against its "enemies", then came even more of them.

And as it was always about corner cases here, not some fundamental principles, following the letter, but not the spirit of law, coupled with badly written laws is what enables them to be

In a country with mature legal system such laws simply would've never passed.
