@georgetakei War already is illegal. War is a crime against peace / a crime of aggression. See UN Charta and the Rome statute. However, self-defense is not constitute a crime. That would be weird if you are not allowed to defend you any more.

@georgetakei The US and their coalition forces definitely committed war crimes. However, war crimes are much easier to prove than crimes against humanity. A widespread or systematic act against the civilian population is much more difficult to prove and debatable. I do not say that there are no cases, I only say that it's hard to prove. Look into the trials ICC and you see how difficult that is.

@georgetakei By the way: You do know how there were 16 million Chinese civilians killed during WWII? The Japanese did want to kill the Chinese and used a diverse set of biological and conventional weapons against them. Just think of the infamous unit 731. Also, have a look at the massacre of Nanjing. That's what also can happen to you if you surrender.

Even if you supply weapons to someone and that one attacks you, you are still attacked and can defend yourself. In that case, supplying weapons to this entity was a bad idea, but that does not matter.

@georgetakei Beware: Not all war crimes are crimes against humanity (cahs) and not all caha are warcrimes. War crimes are mostly acts that are deemed unlawful by the Hague conventions and the Geneva convention as well as other humanitarian law.

A Crime against humanity does not require a war. However, it does require a "widespread or systematic attack against a civilian population".

While all acts that were described are certainly war crimes, only some of them are also cahs.

IMHO, the crime of aggression, which is the preparation and / or fighting of an attack war is one of the greatest crimes that exist. Crimes that are similarily severe are crimes against humanity and genocide. The differences can be found in the German VStGB.
